Terms of Service
These terms are the agreement between Bintera Technologies LLC (“Bintera”, “we”) and the organization that signs up for Bintera (“Customer”, “you”). The person who accepts them confirms they are authorized to do so on the organization’s behalf.
1. The service
Bintera provides short, interactive security awareness lessons, the tools to assign them to your people, reminders, reporting and related features (the “Service”). We may improve and change the Service over time; we will not materially reduce the core features of a paid plan during its current term.
Bintera does not send simulated phishing emails or other deceptive messages to your people.
2. Accounts and access
- Administrators and learners sign in with Microsoft or a one-time email link. Keep access to those mailboxes and Microsoft accounts secure; anything done through your accounts is your responsibility.
- You decide who is enrolled, which lessons they receive and who has administrator rights. You are responsible for having the right to enroll each person and to share their name and work email with us.
- The Service is designed for adults in a work setting. Do not enroll anyone under 16.
- Tell us promptly at security@bintera.com if you suspect unauthorized access to your account.
3. Free trial
New organizations can try Bintera free for 14 days, for up to 25 people, without a payment card. The trial ends automatically; nothing is charged unless you choose a paid plan. We may change or end trial offers for future sign-ups.
4. Plans, fees and renewal
- Teams plan: the per-person price shown on our pricing page at the time of purchase, billed yearly in advance, with the minimum number of people shown there. Enterprise plans are priced in a written order.
- Adding people: if you enroll more people than you have paid for, we may bill the difference for the rest of the current term.
- Renewal: plans renew for another year unless either side cancels before the renewal date. We will email the account owner at least 30 days before a yearly renewal, and before any price increase takes effect.
- Payment: card payments are handled by our payment processor; Bintera does not store card numbers. Fees exclude taxes, which you pay where they apply.
- Refunds: fees are non-refundable except where required by law, or where we end the Service without cause, in which case we refund the unused part of prepaid fees.
5. Acceptable use
You will not, and will not let anyone else:
- use the Service to deceive, harass or harm anyone, or to send messages that are not part of genuine training;
- upload health records, financial account numbers, government identifiers or other sensitive personal data — the Service only needs names, work emails and departments;
- probe, scan or test the Service’s security except under our responsible disclosure approach, or try to access another customer’s data;
- copy, download, record, resell or redistribute the lessons outside the Service, or use them to build a competing product;
- overload, disrupt or reverse engineer the Service, except where the law allows it despite this restriction.
6. Your data
You own the information you and your people put into the Service (“Customer Data”). We use it only to provide, secure and support the Service for you, as described in our Privacy Policy and Data Processing & Security Terms, which form part of these terms. We do not sell Customer Data or use it for advertising.
You can export your organization’s data at any time from Settings. If you delete your organization, everyone loses access immediately and the data is permanently erased after 30 days.
7. Our content
The lessons, videos, briefings, software and branding are owned by Bintera or our licensors. While your plan is active, we grant you a non-exclusive, non-transferable right for your enrolled people to use them through the Service for your internal training. Feedback you give us may be used to improve the Service without obligation to you.
8. Connected services
If you connect Microsoft 365, a chat tool, a webhook or the Outlook report button, you authorize us to exchange the data needed for that connection. Those services are governed by their own terms, and we are not responsible for them.
9. Availability and support
We work to keep the Service available and to fix problems quickly, but it is provided without a guaranteed uptime unless an Enterprise order says otherwise. Planned maintenance is scheduled to limit disruption. Support is by email at hello@bintera.com.
10. Disclaimers
Training reduces risk but cannot guarantee that your people will never fall for a scam, and completion records support but do not by themselves establish compliance with any law or standard. Except as expressly stated in these terms, the Service is provided “as is” and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows.
11. Limits of liability
To the extent the law allows: (a) neither side is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, however caused; and (b) each side’s total liability under these terms is limited to the fees you paid for the Service in the 12 months before the event giving rise to the claim. These limits do not apply to your payment obligations, to breaches of section 5, or to liability that cannot be limited by law.
12. Indemnity
You will defend and indemnify Bintera against third-party claims arising from Customer Data you provide without the right to do so, or from your breach of section 5. We will defend and indemnify you against third-party claims that the Service, used as permitted, infringes their intellectual property rights.
13. Ending the agreement
- You can stop using the Service at any time, and cancel renewal by emailing hello@bintera.com before the renewal date.
- Either side may end the agreement if the other materially breaches it and does not fix the breach within 30 days of written notice.
- We may suspend access immediately if needed to stop serious harm, unlawful use or a security threat, and will tell you why.
- Sections 6, 7, 10, 11, 12 and 15 continue after the agreement ends.
14. Changes to these terms
We may update these terms. For material changes we will email the account owner at least 30 days in advance; changes then apply from your next renewal, or sooner if you accept them. The date at the top shows the current version.
15. General
These terms are governed by the laws of the state in which Bintera Technologies LLC is organized, without regard to conflict-of-law rules, and disputes will be heard in the state or federal courts located there, unless a signed Enterprise order says otherwise. If any part is unenforceable, the rest remains in effect. Neither side may assign these terms without the other’s consent, except to a successor of its business. Notices to us go to legal@bintera.com; notices to you go to the account owner’s email.
